\nThis document informs you on the Privacy Statement (the \u201cStatement<\/strong>\u201d) set up by Dialog Insight (\u201cDIALOG INSIGHT<\/strong>\u201d or \u201cus<\/strong>\u201d), as owner and operator of the application Dialog Insight (app.dialginsight.com or myapp.dialoginsight.com) and its specialized modules (including the Journey tool or behavioral tracking and measurement features), as well as the website www.dialoginsight.com<\/a> to ensure the preservation of the privacy of your personal or confidential information.\n<\/p>\n\n

WHAT WE MEAN BY \u201cPERSONAL INFORMATION\u201d?<\/strong><\/h4>\n\n

\n\u201cPersonal information\u201d is information concerning a physical person that allows identification of such person. For example, your name, residential address, personal phone number and e-mail address, date of birth or access information to applications.\n<\/p>\n\n

\nThis Statement applies to DIALOG INSIGHT\u2019s conduct in regards to personal information of individuals and, based on circumstances, in regards to confidential or sensitive information of enterprises (collectively called the \u201cInformation<\/strong>\u201d) that subscribed to Dialog Insight and also to clients\u2019 conduct in regards the use of Dialog Insight.\n<\/p>\n\n

1) PURPOSE OF COLLECTION<\/strong><\/h4>\n\n

For our uses :<\/strong><\/p>\n\n

\nDIALOG INSIGHT determines the purposes for which it collects personal information before or at the time thereof, unless such purposes are obvious. It is possible that DIALOG INSIGHT may collect and use information from a third party if permitted by law and with the consent of the individual in all other cases.\n<\/p>\n\n

\nWe collect Information upon your registration as client. More particularly, we collect your name, e-mail address, mailing address and phone and fax numbers. In order to complete your registration, we provide you with a user name (that may or not reveal your identity, at your choice) and an access code. It is your responsibility to maintain the confidentiality of your access code. Once registered, you may modify your access code through the feature provided to this end.\n<\/p>\n\n

In the context of the website for users of its platform:<\/strong><\/p>\n\n

\nWe also collect through the forms on our website the information you have chosen to give us such as your name, last name and email address. The information collected enables us to respond to your request (eg request for information form) or to give you access to privileged resources (ex: webinars). Also, the information collected allows us to establish your customer profile, visitor or other and better meet your needs. The information collected through our web forms is only used by Dialog Insight.\n<\/p>\n\n

\nWe measure message interactions such as clicks, opens, and website navigation in order to assess the effectiveness of our communications and to enhance the user experience.\n<\/p>\n\n

Through the use of our applications and Journey measurement tools by our clients:<\/strong><\/p>\n\n

\nOur applications provide our clients with functionalities that allow them to collect data and perform behavioral measurement and tracking based on navigation journeys, including actions carried out within messages (Email, SMS, Push notifications, etc.), such as clicks, opens, and website browsing history. These data are used to assess the effectiveness of communications for users of the platform or to trigger follow-up or remarketing scenarios.\n<\/p>\n\n

\nDialog Insight provides these technologies to its clients (either directly or through authorized resellers) but does not use these data for its own purposes. Such uses are governed by the clients\u2019 own privacy policies, and clients remain responsible for ensuring compliant use, including the implementation of consent management mechanisms allowing individuals to opt out of such tracking.\n<\/p>\n\n

\nAs part of these client uses, cookies are installed on end users\u2019 devices to enable these functionalities. These cookies have specific purposes and appropriate retention periods. Further details are available in the document Journey Module User Guide: Dialog Insight \u2013 Support<\/a>, or upon request.\n<\/p>\n\n

2) USE OF THE INFORMATION<\/strong><\/h4>\n\n

\nDIALOG INSIGHT will not sell, give or exchange your Information to third parties for commercial purposes without your consent. In addition, DIALOG INSIGHT and its clients undertake not to rent, sell or share Information of clients or recipients to third parties without the consent of registered clients or recipients except in exceptional circumstances as specifically described herein.\n<\/p>\n\n

\nFurthermore, the data stored within the Dialog Insight platform remain the exclusive property of Dialog Insight\u2019s clients, with Dialog Insight acting as a data processor on their behalf. It is the responsibility of those clients to define and comply with their own privacy statements or policies.\n<\/p>\n\n

\nWhen users are clients of a Dialog Insight reseller or partner, this Privacy Policy applies by adapting the client relationship to that of the reseller\u2019s or partner\u2019s clients.\n<\/p>\n\n

A. SERVICE MANAGEMENT<\/strong><\/p>\n\n

\nAt a general level, we use your Information in the execution of the Dialog Insight Service, for billing purposes and, in specific cases, to resolve technical problems. Users of the Dialog Insight application agree to receive such communications.\n<\/p>\n\n

B. LEGAL OBLIGATION<\/strong><\/p>\n\n

\nDIALOG INSIGHT may have to disclose your Information to competent persons or authorities should it be needed to conform to any legal obligation or comply with an injunction order, to protect and defend its rights or to assure compliance with the Terms of Use of its services.\n<\/p>\n\n

C. USE OF GOOGLE SERVICES AND API DATA<\/strong><\/p>\n\n

\nWhen you choose to connect your Google account to our platform, Dialog Insight accesses certain Google account data strictly to provide the requested integration. Specifically:\n<\/p>\n\n

\n\u2022 Scope of Access: We access Google Ads Customer Match data to create, update, and manage user lists in your own Google Ads account. No other Google account data is accessed.\n<\/p>\n\n

\n\u2022 Purpose of Use: This data is used solely to synchronize contact segments from Dialog Insight into your Google Ads account, allowing you to manage your audiences.\n<\/p>\n\n

\n\u2022 Data Handling: Contact information uploaded to Google Ads is hashed client-side before transmission, in accordance with Google Customer Match requirements. We do not store, reuse, or share this Google data beyond what is required to perform the requested action.\n<\/p>\n\n

\n\u2022 User Consent: All access to Google account data occurs only after you explicitly authorize it via the OAuth consent screen.\n<\/p>\n\n

\n\u2022 Limited Use Compliance: Google data obtained through the API is never used for unrelated purposes, including advertising, analytics, or profiling outside of the scope of your account operations.\n<\/p>\n\n

\n\u2022 In-Product Notice: When initiating the Google integration, you will see a clear notice within the application explaining what Google data will be accessed and linking directly to this Privacy Policy.\n<\/p>\n\n

3) INFORMATION PROTECTION<\/strong><\/h4>\n\n

\nDIALOG INSIGHT conforms namely to GDPR or the Canadian Personal Information Protection and Electronic Documents Act together with the Act respecting the protection of personal information in the private sector of Quebec or any other law in force in relation with the use of our services. DIALOG INSIGHT uses various measures to ensure the integrity and confidentiality of your Information. These measures are aimed at preventing the loss or theft of your Information, as well as its unauthorized reproduction, modification, use, consultation and disclosure.\n<\/p>\n\n

\nOur Site and applications are secured through the use of technology recognized in the industry. Access to your Information is provided to authorized personnel only, and this, solely for the purposes mentioned in this Statement or dictated by the service offered. Agreements are also signed between DIALOG INSIGHT and its employees so that your Information is used in conformity with the present Statement and with any applicable law, rule or regulation.\n<\/p>\n\n

\nWe use our clients\u2019 data exclusively within systems under our control. Only business-related data are stored in our customer relationship management (CRM) system and our accounting system, which are external systems.\n<\/p>\n\n

\nWe may use third-party service providers for the transmission of SMS messages (CM Telecom, Sinch, or Twilio) or mobile notifications (Google), as well as other channels (such as Meta and its affiliated companies or Internet bandwidth providers). Only transmission-related information (token or mobile number) and message content are transmitted through these third parties, in a secure manner, without any additional identifying information. No personal information is stored by these providers. These service providers are not authorized to retain or use the transmitted information for any purpose. We consider that these providers implement data protection measures that are adequate for the intended purposes.\n<\/p>\n\n

4) EXCEPTIONS<\/strong><\/h4>\n\n

\nIn the event that we intend to use or disclose your Information for purposes other than those specifically described in this Statement, we undertake to obtain your consent.\n<\/p>\n\n

\nDepending on the nature of the information, your consent may be provided verbally, by means of a form or correspondence or, in certain circumstances, implicitly when your consent may be clearly inferred from your conduct.\n<\/p>\n\n

5) CONSERVATION<\/strong><\/h4>\n\n

\nDIALOG INSIGHT retains personal information as long as reasonably necessary for the identified purposes or as required by law.\n<\/p>\n\n

\nThird-party cookies are kept on your browser usually between 30 to 90 days, possibly longer in some cases (eg Google Analytics cookies).\n<\/p>\n\n

6) ACCURACY AND UPDATE OF INFORMATION<\/strong><\/h4>\n\n

\nWe wish to ensure that the Information kept in our cients\u2019 files is accurate, complete and up to date. It is therefore important to inform us of any relevant changes in your personal Information or your business contact information. You are also authorized to consult your file in order to verify accuracy of your Information by any of the means offered to you for such purpose.\n<\/p>\n\n

\nRecipients of e-mail transmission lists are invited to communicate directly with the client to correct or validate personal information related to their subscription to marketing e-mail messages.\n<\/p>\n\n

\nThis Statement may be updated from time to time. DIALOG INSIGHT reserves the right to modify this Statement at its discretion, by adding or subtracting certain terms and conditions.\n<\/p>\n\n
