1. Purpose
This Cookies and Tracking Technologies Notice (the “Notice”) describes the principles governing the use of cookies, tracking pixels, local storage technologies, web beacons, and other similar technologies (collectively, the “Tracking Technologies”) by Dialog Insight.
This Notice supplements our Privacy Policy by providing additional information about the Tracking Technologies we use, their purposes, the applicable consent mechanisms, the respective responsibilities of Dialog Insight and its customers, and the ways users can manage their preferences.
This Notice applies to the Tracking Technologies used on the Dialog Insight website, within its platform, specialized modules, electronic communications, and the functionalities made available to its customers. Depending on the context, these technologies may be used either by Dialog Insight for its own business activities or by its customers through the platform.
2. What are Tracking Technologies?
Tracking Technologies are technical mechanisms used to recognize a device, browser, or user session, or to measure certain interactions with a website, platform, or electronic communication.
They are used for a variety of purposes, including ensuring the proper operation of our services, maintaining active user sessions, remembering user preferences, improving the user experience, measuring the use and performance of our services, supporting personalization and automation features, and evaluating the effectiveness of electronic communications.
The primary Tracking Technologies used by Dialog Insight include session cookies, persistent cookies, local storage technologies (Local Storage), tracking pixels, web beacons, technical identifiers, and other similar technologies.
3. Our role
Depending on the context, Dialog Insight may use Tracking Technologies for its own business activities or provide these capabilities to its customers through the platform.
- When Dialog Insight uses Tracking Technologies for its own purposes, it acts as the data controller.
- When these technologies are used by customers through the platform, Dialog Insight generally acts as a service provider or data processor on behalf of its customers.
4. Tracking Technologies we use
4.1 On our Website
To ensure the proper operation of our website and enhance the browsing experience, Dialog Insight uses various Tracking Technologies, including cookies, local storage technologies (Local Storage), and, where appropriate, other similar technologies.
These technologies are used, among other things, to:
- ensure the proper functioning of the website;
- recognize visitors during a browsing session or on subsequent visits;
- remember certain user preferences;
- measure website traffic and performance;
- improve the user experience;
- evaluate the effectiveness of our communications and marketing campaigns; and
- support certain personalization and marketing features.
Whenever possible, Dialog Insight gives preference to browser-based Local Storage technologies. Local Storage allows certain information to be stored directly within the user’s browser in order to improve performance and enhance the user experience. Where Local Storage is not available or suitable, certain functionalities may instead rely on session cookies or persistent cookies.
The information collected through these technologies is used solely for the purposes described in this Notice and in our Privacy Policy. These technologies do not allow us to access information stored elsewhere on a user’s device and are not used to retrieve information from a user’s hard drive or other applications.
Certain website features may also rely on Tracking Technologies provided by third parties. Where user consent is required, these technologies are used in accordance with the user’s expressed preferences and remain subject to the privacy policies of their respective providers.
Tracking Technologies that are strictly necessary for the operation of the website cannot be disabled when they are essential to providing the requested service. Other Tracking Technologies may be managed through our consent management platform or through your browser settings, as applicable.
4.2. Within the Dialog Insight Platform
The Dialog Insight platform uses Tracking Technologies that are essential to its operation, including technologies required to authenticate users, manage user sessions, secure access, remember certain preferences, and ensure the proper functioning of platform features. Disabling some of these technologies may prevent certain functionalities from operating correctly.
4.3 Electronic communications and behavioral tracking
Dialog Insight may use tracking pixels and tracked links in electronic communications sent to its customers, prospects, and subscribers in order to measure interactions with those communications, including email opens, link clicks, message deliverability, and overall communication performance.
The Dialog Insight platform also enables its customers, either directly or through authorized resellers, to use these technologies in their own electronic communications and within the Journey module.
4.3.1 Use of the Journey Module by our customers
The Journey module provides Dialog Insight customers with features that enable them to measure and analyze interactions between their users and their electronic communications or digital properties.
Depending on the features enabled by the customer, these technologies may measure:
- email opens;
- link clicks;
- interactions with messages (including emails, SMS messages, push notifications, and other communication channels);
- website visits and browsing journeys;
- interactions with specific content; and
- conversions and other behavioral events configured by the customer.
This information enables customers to evaluate the performance of their communications, better understand user interactions, and, where configured by the customer, personalize communications, support automated workflows, and trigger follow-up actions.
Dialog Insight provides these capabilities solely in its capacity as a service provider or data processor and does not use the information collected through these technologies for its own purposes. Processing activities carried out through the Journey module remain under the responsibility of our customers, who are responsible for determining the purposes of processing, the applicable legal basis or other lawful basis under applicable laws, the consent mechanisms required, and compliance with applicable legal requirements.
To support these functionalities, certain Tracking Technologies may be stored on users’ devices. Details regarding the technologies used, their purposes, retention periods, and whether they are essential or optional are provided in the Dialog Insight Tracking Technologies Register.
4.3.2 Tracking pixels and tracked links
Tracking pixels generally consist of an invisible image or remote resource that is loaded when an electronic communication is opened. Tracked links enable the measurement of interactions with links contained within those communications.
Depending on their configuration, these technologies may measure or collect:
- confirmation that a message has been opened;
- the date and time the message was opened;
- clicks on links contained in the communication;
- certain technical information relating to the email application or device used;
- information necessary to ensure message deliverability; and
- events supporting the personalization, automation, and journey functionalities offered by the platform.
4.3.3 Purposes of tracking pixels and tracked links
Depending on the context and the features used, tracking pixels and tracked links may be used to:
- measure the performance and effectiveness of electronic communications;
- improve the relevance of communications;
- support the personalization, automation, and journey functionalities offered by the platform;
- ensure message deliverability and detect transmission errors;
- prevent technical incidents and abusive use; and
- generate usage and performance statistics.
When Dialog Insight uses these technologies in connection with its own communications, they are used solely to improve its communications, services, and user experience. They are not used by Dialog Insight for profiling or advertising purposes.
When these technologies are used by customers through the platform, the purposes of processing are determined by those customers, who remain responsible for ensuring that their use complies with applicable laws, including requirements relating to user information and consent where applicable.
5. Consent Management
5.1 Consent applicable to tracking technologies
Certain Tracking Technologies, including tracking pixels embedded in electronic communications, may require prior consent when they are used for purposes such as individual measurement, personalization, profiling, segmentation, automation, or when they are combined with other personal information, in accordance with applicable laws and the guidance of competent regulatory authorities, including the French Data Protection Authority (CNIL).
Consent to receive an electronic communication is separate from consent to the use of certain Tracking Technologies. Where Dialog Insight acts as a service provider or data processor, it is the customer’s responsibility to determine its legal obligations and to obtain any consent required under applicable laws.
5.2 Tracking Technologies exempt from consent
Certain Tracking Technologies may be exempt from consent requirements where they are strictly necessary to provide, secure, or maintain the requested service, or where an exemption is permitted under applicable law. This may include technologies used to maintain an active session, prevent fraud, ensure the security of our services, measure message deliverability, or detect technical errors.
5.3 Managing preferences and withdrawing consent
Where the use of Tracking Technologies is based on your consent, you may withdraw your consent or modify your preferences at any time. Depending on the context, you may do so through our cookie banner or preference center (where available), by using the unsubscribe or preference management link included in our communications, through your browser settings, or by contacting Dialog Insight.
Where Tracking Technologies are used by a Dialog Insight customer through the platform, requests relating to communication preferences, consent withdrawal, or other privacy choices should generally be directed to the applicable customer.
6. Third-Party Technologies
Certain features of the Dialog Insight website or platform may rely on Tracking Technologies provided by third parties to measure audience activity, improve performance, support specific functionalities, or enable integration with external services. Dialog Insight selects its third-party providers based on security, privacy, and compliance considerations. The use of these third-party technologies is also governed by the privacy policies of their respective providers.
6.1 Transparency & Consent Framework (TCF)
Dialog Insight is registered as a Vendor within the IAB Europe Transparency & Consent Framework (TCF), an industry framework designed to standardize transparency and the communication of users’ consent choices in accordance with the General Data Protection Regulation (GDPR).
Within this framework:
- the collection and management of users’ consent are carried out by our customers through their own Consent Management Platform (CMP);
- Dialog Insight processes personal information in accordance with the documented instructions of its customers, who remain responsible for determining and documenting the applicable legal basis or other lawful basis for the processing activities they perform (including consent where required);
- where technically supported, Dialog Insight honors the consent signals transmitted by the customer’s Consent Management Platform;
- Dialog Insight complies with the policies and technical specifications of the Transparency & Consent Framework applicable to its role as a Vendor; and information regarding the processing purposes declared by Dialog Insight within the Transparency & Consent Framework is available through the public Vendor Registry maintained by IAB Europe.
Users may exercise their privacy rights in accordance with the privacy policy of the organization with which they interact and, where applicable, manage their consent preferences through that organization’s Consent Management Platform.
Additional information regarding the Transparency & Consent Framework is available on the official IAB Europe website.
7. Retention Periods
Tracking Technologies used by Dialog Insight are retained only for as long as necessary to fulfill the purposes described in this Notice and in accordance with applicable laws. Information collected through Tracking Technologies may be retained for different periods depending on its purpose, the settings configured by our customers, and applicable legal requirements.
Tracking Technologies deployed by Dialog Insight are generally retained for a maximum period of 90 days, consistent with the retention periods declared in our transparency registry. Tracking Technologies provided by third parties may be subject to different retention periods in accordance with their respective privacy policies.
The applicable retention periods for the Tracking Technologies used within the Dialog Insight platform are described in the Dialog Insight Tracking Technologies Register.
8. Changes to this Notice
Dialog Insight may update this Notice from time to time to reflect changes to its services, the Tracking Technologies it uses, or applicable legal requirements.
